1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts between Dustin Hamerla (hereinafter ‚Provider‘) and the customer for the sale of digital music files (e.g., MP3 downloads) on the website modeen.media. The GTC apply in the version valid at the time of contract conclusion.

2. Subject of Contract

The Provider sells digital music content (songs) exclusively in file format for download. The purchase is made through the website modeen.media. After successful payment, the customer receives access to download the purchased files.

3. Contract Conclusion

By clicking the ‚Buy‘ button in the ordering process, the customer makes a binding offer to conclude a purchase contract. The contract is concluded when the Provider accepts the order by providing a download link.

4. Prices & Small Business Regulation

All prices stated on the website are final prices according to § 19 UStG (small business regulation). No VAT is shown.

5. Payment Processing

Payment is made exclusively through the payment service provider Stripe. Upon completion of payment, the customer automatically receives access to the purchased file(s) via download link. The Provider reserves the right to exclude certain payment methods in individual cases.

6. Delivery & Download

Delivery is made digitally by providing a download link immediately after successful payment. The link is sent to the customer by email or provided directly on the website. No physical shipping takes place.

7. Usage Rights

With the purchase, the customer receives a simple, non-transferable right of use for private use of the purchased music files. Commercial use, resale, or public performance is not permitted without the express written consent of the Provider.

8. Right of Withdrawal for Digital Content

For digital content, the right of withdrawal expires with the start of the download, provided the customer has expressly agreed that the execution of the contract begins before the expiry of the withdrawal period and has confirmed that they are aware of the loss of the right of withdrawal (§ 356 para. 5 BGB). Note: Before completing the purchase, the customer will be asked for appropriate consent.

9. Liability

The Provider is only liable for damages based on intentional or grossly negligent breach of duty. No liability is assumed for damages due to faulty downloads or incompatibilities with the customer’s devices.

10. Final Provisions

The law of the Federal Republic of Germany applies. The place of jurisdiction is, insofar as legally permissible, the Provider’s place of business. Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
